Operating Entity: FixMyAir, a fictitious name of Fix N Flip Solutions LLC (Florida)

Welcome to FixMyAir. These Terms of Service (“Terms”) govern your access to and use of the FixMyAir website, tools, services, and related content (collectively, the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

1. Nature of Service

FixMyAir is an online referral and lead-generation platform that connects homeowners with independent, third-party HVAC contractors. FixMyAir is not a licensed HVAC contractor and does not perform, manage, supervise, or guarantee HVAC services. All HVAC work is performed solely by independent contractors.

2. Homeowner Use

Homeowners may use FixMyAir to describe HVAC problems, request service, and be connected with contractors. Homeowners are responsible for verifying contractor credentials, licenses, insurance, pricing, and service terms before agreeing to any work.
FixMyAir does not set contractor pricing, guarantee service availability, or warrant the quality of any work performed.

3. Contractor Use & Payment Terms

Contractors may apply to join the FixMyAir network and, upon acceptance, may be listed or referred to homeowners in their service area.

Payment:

  • Contractors agree to pay the applicable subscription fees, lead fees, or founding partner fees for access to FixMyAir’s Platform.

  • All payments are non-refundable unless explicitly stated in writing by FixMyAir.

  • Payments are processed through secure third-party payment providers (e.g., Stripe). FixMyAir does not store payment card information.

Service Payments:

  • FixMyAir does not collect or disburse service payments between homeowners and contractors.

  • All pricing, invoicing, and payment for HVAC work is arranged directly between homeowner and contractor.

  • FixMyAir is not a party to those agreements and bears no responsibility for payment disputes, refunds, or service issues.

Right to Modify Pricing:
FixMyAir reserves the right to adjust pricing structures, payment schedules, or available plans with reasonable notice to participating contractors.

4. Data Collection & Privacy

FixMyAir collects limited personal information from users to facilitate referrals and improve the Platform. We do not sell personal data to third parties. Please review our Privacy Policy for full details.

5. Intellectual Property

All content, branding, logos, and software associated with FixMyAir are the property of Fix N Flip Solutions LLC. Users may not copy, modify, or distribute Platform materials without express written permission.

6. Limitation of Liability

To the fullest extent permitted by law, FixMyAir shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, or for any liability related to HVAC services performed by third parties.

7. Indemnification

Users agree to indemnify and hold harmless FixMyAir, its owners, affiliates, and employees from any claims, damages, losses, or expenses arising from their use of the Platform or interactions with contractors or homeowners.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard
